"Usage of this site is governed by the following terms and conditions:

THIS AGREEMENT is made between Tinfo Property and you ("the User")

Definition:

"Effective Date" - the date on which this set of terms and conditions entered effect.

"Intellectual Property Rights"- all copyrights, patents, registered and unregistered design rights, database rights, trademarks and service marks and applications for any of the foregoing, together with all trade secrets, know-how, rights to confidence and other intellectual and industrial property rights in all parts of the world.

"Material" - content published on the Website or otherwise provided to Tinfo Property. For the avoidance of doubt, it includes all content posted on the Website by the User or otherwise provided to Tinfo Property by the User.

"Registration Details" - the details which a User must provide on registering for the Website including name, phone numbers, email address, age or address.

"Service" - the provision of the Website as a property portal.

"Unacceptable" - Material which under the laws of any jurisdiction from which the Website may be accessed may be considered either:-

a. illegal, illicit, indecent, obscene, racist, offensive, pornographic, insulting, false, unreliable, misleading, alleged to be or actually defamatory or in infringement of third-party rights (of whatever nature and including, without limitation, any Intellectual Property Rights);

b. in breach of any applicable regulations, standards or codes of practice (notwithstanding that compliance may not be compulsory);

c. to contravene legislation, including without limitation, that relating to weapons, animals, or alcohol.

d. might harm Tinfo Property's reputation.

"User"- any party who uses the Website.

"Website" - Tinfo Property's website located at www.tinfoproperty.com

"Tinfo Property" - Tinfo Property which is the owner of the Website and whose registered office is Plot: 19 and 20, Road: 113/A, Gulshan-02, Dhaka-1212, Bangladesh.

2. Terms Which Apply to Users:

2.1. In registering for this Website, the User must provide true, accurate, current, and complete Registration Details, which the User must update after any changes before using the Website for further services in the future.

2.2. The User hereby warrants to Tinfo Property that they are at least eighteen years of age and legally able to enter into contracts.

2.3. Tinfo Property reserves the discretion to withdraw any Material from the Website without prior notice and to refuse any Material posted by a User.

2.4. The User's Registration Details and data relating to their use of the Website will be recorded by Tinfo Property, but this information shall not be disclosed to third parties (otherwise than on an aggregated, anonymous basis) nor used for any purpose unrelated to the Website.

2.5. Tinfo Property may send a small file to the User's computer when they visit the Website. This "cookie" will enable Tinfo Property to identify the User's computer, track its behavior on the Website, and identify the User's particular areas of interest to enhance their future visits to the Website. The cookie will not enable Tinfo Property to identify the User and Tinfo Property shall not use it otherwise than in relation to this Website. The User can set its computer browser to reject cookies, but this may preclude the use of certain parts of this Website.

2.6. The User hereby authorizes Tinfo Property to use any information they submit to this Website to inform the User of special offers, occasional third-party offers, and for other marketing and related purposes. Tinfo Property will not use User data for any other purposes than as set out in this Agreement except that Tinfo Property may disclose this data if compelled to do so by law or at the request of a law enforcement agency or governmental authority.

2.7. If the User does not wish Tinfo Property to use their information as set out in Clauses 2.3 and 2.4 above, they should leave the Website before submitting their personal details.

2.8. If the User does not want Tinfo Property to use their email address to send information concerning the Website and related matters, the User should send a message to Tinfo Property and insert "unsubscribe" as the subject heading.

2.9. Tinfo Property reserves the right to suspend or terminate a User's account where, in its absolute discretion, it deems such suspension appropriate. In the event of such suspension or termination, Tinfo Property will notify the User by email, and the User must not seek to re-register either directly or indirectly through a related entity.

2.10 For the avoidance of doubt, Tinfo Property is providing a service, not goods.

2.11 Tinfo Property owns all Intellectual Property Rights in the Website and the Service, including, without limitation, the design, text, graphics, the selection and arrangement thereof.

2.12. Tinfo Property takes reported and actual infringement of Intellectual Property Rights and fraud extremely seriously and while Users cannot hold Tinfo Property liable in relation to such issues, Tinfo Property requests all Users to report such matters immediately, and Tinfo Property shall inform the appropriate authorities.

2.13. Users will be invited to send comments to Tinfo Property by email relating to the integrity and performance of other Users.

2.14. The following restrictions shall apply to all Users:

a. User agrees not to transmit any material designed to interrupt, damage, destroy, or limit the functionality of the Website or the Service.

b. User agrees not to use any automated software to view the Service without consent and to only access the Service manually.

c. User agrees not to use the Service other than for their own personal use or as an agent listing property for sale and to rent.

d. User agrees not to attempt to copy any Material or reverse engineer any processes without Tinfo Property's consent.

e. User agrees not to use any Service in any manner that is illegal, immoral, or harmful to Tinfo Property.

f. User agrees not to use any Service in breach of any policy or other notice on the Website.

g. User agrees not to remove or alter any copyright notices that appear on the Website.

h. User agrees not to publish any Material that may encourage a breach of any relevant laws or regulations.

i. User agrees not to interfere with any other User's enjoyment of the Website or the Service.

j. User agrees not to transmit materials protected by copyright without the permission of the owner.

k. User agrees not to conduct itself in an offensive or abusive manner while using the Website or the Service.

2.15. By submitting Material on the Website or otherwise, User grants Tinfo Property a royalty-free, perpetual, irrevocable, and non-exclusive right and license to use, reproduce, distribute, display, modify, and edit the Material. Tinfo Property will not pay the User any fees for the Material and reserves the right in its sole discretion to remove or edit the Material at any time. User also warrants and represents that it has all rights necessary to grant Tinfo Property these rights.

2.16. Tinfo Property permits the User to post Material on the Website in accordance with Tinfo Property's procedures provided that Material is not illegal, obscene, abusive, threatening, defamatory, or otherwise objectionable to Tinfo Property.

3. Limitation of Liability:

3.1. Tinfo Property is not liable for any indirect loss, consequential loss, loss of profits, revenue, data, or goodwill howsoever arising suffered by any User arising in any way in connection with this Agreement or for

any liability of a User to any third party.

3.2. Notwithstanding any other provision of this Agreement, Tinfo Property's entire liability to a User shall be limited to the amount, if any, paid by the User for the Service or Material in question.

3.3. Nothing in this Agreement shall exclude or limit Tinfo Property's liability for death or personal injury due to its negligence or for fraudulent misrepresentation.

3.4. Tinfo Property accepts no liability for any loss suffered by a User as a result of:

a. any reliance placed on the accuracy or completeness of the Material posted on the Website; or

b. any changes Tinfo Property may make to the Website or the Service or for any temporary interruptions in the provision of the Website or the Service.

3.5. Tinfo Property shall not be liable for any loss suffered by a User or any third party resulting from the provision of the Service, including but not limited to any:

a. loss of business;

b. loss of revenue;

c. loss of profits;

d. loss of anticipated savings;

e. wasted expenditure;

f. loss of privacy and loss of data;

g. loss of goodwill or reputation;

h. special or indirect loss; or

i. other economic losses.

3.6. Tinfo Property shall not be liable for any interruptions to the Service, whether intentional or otherwise.

4. Disclaimer:

4.1. Tinfo Property does not give any warranty or other assurance as to the operation, quality or functionality of the Website or the Service. Access to the Website may be interrupted, restricted, or delayed for any reason.

4.2. Tinfo Property also does not give any warranty or other assurance as to the material appearing on the Website, its accuracy, completeness, timelessness, or fitness for any particular purpose.

4.3. To the full extent permissible by law, Tinfo Property disclaims all responsibility for any damages or losses (including, without limitation, financial loss, damages for loss in business projects, loss of profits, or other consequential losses) arising in contract, tort, or otherwise from the use of or inability to use the Website or any material appearing on Tinfo Property, or from any action or decision taken as a result of using Tinfo Property or any such material.

4.4. The Website contains material submitted and created by private and trade advertisers and other third parties. Tinfo Property excludes all liability for any illegality arising from or error, omission, or inaccuracy in such material.

c. the completeness of the results of any search of the Website or that the property selected by the search are the only property on the Website which might meet the searcher's requirements.

4.6. Tinfo Property shall not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.

4.7. Tinfo Property shall not be liable for any damage or loss whatsoever caused by the submission of any material to the Website.

4.8. Tinfo Property shall not be liable to a User for any loss or damage suffered by a User as a result of the use of the chatbot facility on the Website.

4.9. Tinfo Property shall not be liable for any loss or damage whatsoever caused by issues arising from the internet or telecommunications service provider (including but not limited to the User's internet service provider or Tinfo Property's hosting services provider).

5. User's Obligations:

5.1. The User shall not:

a. use the Service for any illegal purpose and the User agrees to use it in accordance with all relevant laws;

b. upload or transmit through the Service (whether by way of User comments, a user review or otherwise) any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information;

c. attempt to gain unauthorized access to our site, the server on which our site is stored, or any server, computer or database connected to our site;

d. post or transmit Material that threatens, harasses, defames, abuses, or embarrasses another person or entity;

e. post or transmit Material that discusses illegal activities with the intent to commit them;

f. post or transmit Material that contains advertising or commercial messages;

g. post or transmit Material that is obscene, offensive, sexually explicit, or inappropriate;

5.2. The User will be responsible for any breach of these terms by them and, where applicable, Tinfo Property reserves the right to report any breach of these terms to the relevant law enforcement authorities and disclose your identity to them.

6. Security and Privacy:

6.1. Tinfo Property will take all reasonable steps to ensure the security of the Website and User information.

6.2. Tinfo Property shall comply with all applicable Data Protection legislation from time to time in force in respect of any personal information relating to the User gathered by Tinfo Property in the course of the User's use of the Website.

7. Force Majeure:

7.1. Tinfo Property shall not be held to be in breach of its obligations hereunder nor liable to the User for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government, regulatory authorities, or other competent authority, or any act or default of any supplier, agent or sub-contractor.

8. General:

8.1. These terms and conditions may be varied by Tinfo Property from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

8.2. These terms and conditions and

the relationship between Users and Tinfo Property shall be governed by the laws of England and Wales, and the English courts will have exclusive jurisdiction over any dispute.

8.3. Any failure by Tinfo Property to exercise any right or remedy under these terms and conditions shall not constitute a waiver of that right or remedy.

8.4. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these terms and conditions shall remain in full force and effect.

8.5. This Agreement and the User's rights and obligations hereunder are not assignable, transferable, delegable, or sub-licensable by the User except with Tinfo Property's prior written consent. Any purported assignment, transfer, delegation, or sublicense shall be null and void.

8.6. Both the User and Tinfo Property will comply with all applicable laws and regulations in performing this Agreement.

8.7. This Agreement represents the entire agreement between the User and Tinfo Property concerning the subject matter hereof.
